- EOHCB: Compliance & Non-Compliance In Terms of Registration With The HCSBC, Including the Process
Non-compliance orders and the process 1. MANDATORY REGISTRATION WITH THE BARGAINING COUNCIL All establishments operating within the hair and beauty industry are legally required to register with the Bargaining Council to ensure compliance with the Main Collective Agreement. In terms of Clause 5 and 6 of the Agreement: Employers must complete and submit Annexure A Employees must complete and submit Annexure B Failure to comply with this registration requirement will result in a compliance order being issued by a designated agent of the Council. 2. NON-COMPLIANCE PROCEDURE If an establishment fails to comply with the compliance order: The matter will be set down for arbitration, where the employer will be required to provide reasons for non-compliance. An amount of R1,500 will be billed to the employer for the arbitration proceedings. Continued non-compliance will result in the arbitration award being submitted to the Commission for Conciliation, Mediation and Arbitration (CCMA) for certification. Once certified, the award is enforceable by the Sheriff of the Court, who shall: Enforce the award as a writ of execution Attach movable property within the establishment Collect any outstanding amounts due until the employer complies with the Bargaining Council’s regulations 3. STATUTORY DEDUCTIONS AND CONTRIBUTIONS Compliance includes making the following statutory deductions and contributions: Employer Contributions: EOHCB subscription or Agency Fee (Bargaining Levy) Pension Fund Sick Pay Fund Council Levy Employee Deductions and Contributions: Union Fee or Agency Fee Pension Fund Sick Pay Fund Council Levy All contributions must be paid over to the Bargaining Council as stipulated in the Main Collective Agreement by the employer. The employer needs to make sure that the employees are paid the correct salaries and wages as per the salary and wages schedule. Failure to pay the correct salaries and wages, the designated agent will also issue a compliance order so that the employer pays the correct salaries and wages to the employees. 4. CONCLUSION Employers are urged to ensure their establishments are fully registered and compliant. Non-compliance can result in legal enforcement actions and financial penalties. When Harriet comes to visit, it’s like a breath of fresh air. Over the past few years, Harriet has been my creative muse, allowing me to use her hair as a blank canvas for bringing my creative vision to life. Why would you not take a risk every now and then? In a world where people seem to be scared to stand out, it’s so refreshing when a client sits in my chair wanting a vivid transformation – and Harriet does just that. For this look, I began by pre-lightening the hair base to a clean level 10, creating the perfect canvas for the design. Using fine brushes, I hand-stitched the design, starting at the centre and working outward to the sides to maintain balance and symmetry. The pink layer was applied first and fully processed to lock in brightness, then gently rinsed before moving on to the next stage. I went back in with a purple colour again, using fine brushes for my line work. I used my fingers as a blending tool on the pattern, adding a tiny amount of pink and softly diffusing to give a shadow corner effect. To really make this look pop, I added a turquoise colour in the centres of this pattern, blending it back into the pink using my fingers to keep the transitions soft. The symmetry, the balance and the explosion of color – what’s not to love about this look! Contracts The contracts for spa and salon staff are a commitment of 9 months. During this time, you will receive 1.5 days off for every 7 days of work. Scheduled days may depend on your ship and itinerary. You will also qualify for one week of vacation time for every month worked. Cruise Ship Assignments Cruise ship assignments are based on business needs, but all assignments offer personal and professional growth as well as an opportunity to save earnings for the future. Each cruise line is different in what they offer – unique destinations, varied mix of guests and demographics, with so many diverse forms of entertainment! Embarkation day We recommend you bring a maximum of 20kg luggage. Anything over this amount may be subject to additional fees. On embarkation day, the spa manager or one of the team members meets you and helps you settle in. After an orientation, prepare to begin working immediately! Accommodation Where you stay and sleep is your sanctuary, a place to escape the work and focus on rest and recovery; read a book; continue studies; plan your future. Except for management, acupuncture and medi-spa physicians, your cabin refuge is shared with a team member. A typical cabin is equipped with a bunk bed to provide some additional space, telephone, small wardrobe closet, dresser, private shower and bathroom facilities. It has everything one would need. Cabins can be personalised by hanging up pictures of loved ones and what inspires you. The space can be made your very own. Dining From the crew dining room to dining on the Lido deck and specialty restaurants, cruise ships offer a myriad of food and beverage options. The crew dining room is open at all times for staff. There is no cost for dining in this crew area. Most ships also feature specialty restaurants at an additional cost. As this is a passenger restaurant, staff reservation confirmations for seating is based on guest demand. On some smaller ships, staff will always dine in the guest dining rooms. For those instances, there is always a crew bar where officers, staff and crew meet to socialise amongst themselves. Communications Calling family and friends has become easier over time, and on many ships you can call home from the comfort of your cabin. Costs vary – but they are very reasonable. E-mail is also an option if you subscribe to the onboard wireless plan. For those staff members who have a mobile phone, you can use your phone to place a call whilst in port and many ports offer complimentary Wifi. Finances There is no limit on your earnings. Wage commissions have a minimum monthly guarantee. A great work ethic combined with a positive attitude will mean you are extremely successful onboard.
