  • Bargaining Council Sept 2025: Info on Staff Status Amendments, Beauty Sector Survey & HBSI Pension Fund

    STAFF AMENDMENTS Establishments are reminded to inform the Council by way of the Staff Amendment Form of any changes in employee status.   Please take note that this would also include any promotion to another position, obtaining a qualification, or progression to the next Learnership level. This will ensure that the employee is correctly registered with the Council and will prevent challenges with your account and compliance issues. The Finance and Administration Department is kindly requesting establishments to complete and submit their Staff Amendment Forms as and when they occur, before the 7th of the month .   Establishments are reminded that when employing new staff, Annexure B - Employee Registration Form – must be completed and submitted to the Council.   The Staff Amendment Form and Annexure B are available on the Council’s website, or you may request the Forms from your Designated Agent.       SURVEY: BEAUTY SECTOR: SOMATOLOGISTS The Council is conducting a survey concerning Somatologists employed in the industry. The survey arises from the many questions that have been raised regarding the indication by the Allied Health Professions Council of South Africa that it would approach the Minister of Health to open a register for Somatologists.   Affected Establishments in the Beauty sector are asked to complete a questionnaire as part of the survey being conducted on Somatologists employed in the industry.   Please kindly cooperate by completing and submitting the questionnaire . A link to the questionnaire has been emailed to establishments in the Beauty Sector who we believe might be affected, based on the data we have on our system. However, if you have not received the survey link, the survey may also be accessed via the Council’s website on SomatologistsSurvey or go to https://hcsbc.co.za/media-events/     Please note that this is an online survey which can be easily completed.   PROCESS PERIOD: EXEMPTION FROM MEMBERSHIP OF THE HBSI: SEPTEMBER TO DECEMBER The four-month timeframe during which exemptions from membership of the HBSI Pension Fund are processed spans from September to December each year, applicable for the next calendar year. Both applications and any appeals must be addressed within this timeframe. Should an exemption not be applied for or approved during this period, an establishment will be obligated to contribute to the HBSI Fund on behalf of its employees, and enforcement actions may ensue in the case of non-compliance.   Establishments are urged to finalise and submit their applications for the 2026 calendar year at their earliest convenience. These applications will be processed during the period from September 2025 to December 2025 .   Current exemptions (for 2025) will automatically terminate on 31 December 2025 , and charges will be raised in accordance with the Collective Agreement if your application is not received for processing within the timeframe and/or if an exemption is not granted.   • EOHCB: Preventing Workplace Harassment - Understanding The Code of Good Practice & Legal Obligations

    South Africa’s Code of Good Practice on the Prevention and Elimination of Harassment, effective since 18 March 2022, provides a comprehensive framework for addressing harassment under the Employment Equity Act (EEA). The Code expands the definition of harassment beyond sexual misconduct to include bullying, cyberbullying, gender-based violence, and discrimination based on race, sex, sexual orientation, or other prohibited grounds. Employers and employees must understand their roles in fostering a harassment-free workplace, as non-compliance risks legal consequences and undermines organisational performance. Key Provisions of the Code Scope of Harassment: The Code defines harassment broadly, encompassing: Sexual harassment (unwanted advances, jokes, or threats). Bullying (physical, verbal, or psychological abuse). Cyberbullying (online stalking, derogatory messages). Discrimination linked to race, gender, disability, religion, or other protected characteristics. There are more than 18 types of behaviours and or conduct which is regarded as harassment: Verbal: Unwanted sexual or romantic advances Sexual jokes, comments, or innuendos Comments about someone's body or appearance Spreading sexual rumours Asking intrusive questions about someone's personal/sexual life Making kissing sounds or whistling Using demeaning terms or slurs Physical: Unwanted touching, hugging, or kissing Blocking someone's path or cornering them Standing too close or invading personal space Inappropriate physical contact disguised as accidental Following or stalking Visual/Non-verbal: Staring or leering Making sexual gestures Displaying sexually explicit images Sending unwanted sexual messages or images Inappropriate exposure Drawing or making sexual graffiti Power-based: Offering work benefits in exchange for sexual favours Threatening negative work consequences for refusing advances Using position to coerce sexual activity Making inappropriate conditions for promotion/advancement Retaliating after rejected advances Digital/Electronic: Sending unwanted sexual emails or messages Sharing inappropriate content via work devices Making sexual comments on social media Taking/sharing photos without consent Making unwanted video calls Importantly: Both subtle and overt behaviours can constitute harassment It can happen to/by any gender A single incident can be harassment if severe enough Intent doesn't determine whether something is harassment - impact matters Power differentials often play a key role All employees have the right to a harassment-free workplace Harassment by employers, employees, clients, or third parties is prohibited. Consult the Employers’ Organisation for Hairdressing, Cosmetology, and Beauty (EOHCB) during the investigation.
