  • Bargaining Council: HBSI Pension Fund & Important Reminders on Payments & Documents

    PENSION FUND CONTRIBUTIONS: ARREARS   The National Bargaining Council’s Main Collective Agreement provides for the compulsory membership, of employees in the industry, of the HBSI Pension Fund.   In the absence of an exemption, it is a legal requirement that employers submit payment of the required contributions to the Council (on behalf of the Employer and of the Employee, as set out in the Main Collective Agreement and Wage schedules) for payment to the Fund and in accordance with the Rules of the Fund.   A failure to pay over contributions as required is not only a contravention of the Pension Fund Act, and a criminal offence, but also potentially leaves employers exposed to legal challenges concerning the impact on other benefits such as risk benefits (e.g. death and serious illness) payable to the members.   The FSCA (Financial Services Conduct Authority) issued warnings and alerts in June 2022 that they would continue with their enforcement efforts in this regard and have done so and continue to do so.   The Council also continues with its enforcement of non-compliance with the Main Collective Agreement   Please urgently attend to any Pension Fund arrears. Should you need assistance in this regard please contact the Designated Agent or Credit Controller in your area or the Council’s offices.    Important Reminders:   REFERENCE ON PAYMENTS   Please remember to include your SAL Number as a reference when making payments to the Council. We are unable to allocate payments to your accounts unless we know which establishments they are to be applied to. Late payments will result in penalties   ANNEXURES A AND B AND STAFF AMENDMENT FORMS   All employers are obliged to ensure that an establishment is registered with the Council. In terms of the Main Collective Agreement, all employers of an establishment must apply to the Council in the form specified in Annexure “A” for registration of the establishment and shall, as part of the registration process, also submit a duly completed Annexure “B” in respect of all Employees employed at the establishment. ( Annexures A and B may be downloaded from the Council’s website www.hcsbc.co.za . The employer must notify the Council of the appointment of an employee (including a learner) by submitting a completed Annexure “B” before the 7th of the month following the appointment.   These documents can be submitted to: accounts@hcsbc.co.za .   In the event of an employee (including a learner) leaving the services of the employer for whatsoever reason, the employer must notify the Council of such termination in writing.   • Mental Health - Setting Boundaries

    To know your personal boundaries, you need to understand yourself and think about what makes you feel uncomfortable or stressed. It’s about knowing when you need to say no or when you need to compromise. Committing to your boundaries means standing up for them when they’re challenged and taking steps to make sure they’re respected. KNOW WHAT TO SAY “YES” TO Reflect on personal wants and needs, prioritizing them accordingly. Think about how you’re spending your time. Know what types of requests you want to say “yes” to and what you don’t have space for right now. TRY TO SPEAK UP Be proactive to prevent misunderstandings. Don’t wait until someone crosses a boundary to say something – that’s too late to protect yourself and can leave the other person feeling confused. Try to speak up in the moment so that the boundary is clear and not crossed in the first place. USE SIMPLE & DIRECT LANGUAGE Just say it. Use simple and direct language to establish a boundary. Don’t dance around what you’re trying to say or expect other people to read your mind. GIVE SOME CONTEXT Offer relevant explanations and solutions. You don’t owe anyone an explanation of your boundaries if you don’t want to share, but giving some context can help others better understand where you are coming from. It’s important to understand that certain situations unique to the salon environment may challenge your boundaries in various ways. AVOID OVERBOOKING OR OVERPROMISING Being a stylist means having a strong desire to help people look and feel their best, and sometimes that leads to overbooking or overpromising. When you set boundaries on your time and expectations of what you’re able to realistically achieve, you and your clients will end up feeling better about the amount of attention you were able to give and the result they leave the salon with. SAYING NO TO TOXIC PEOPLE We’ve all encountered them – the people who walk into the salon and immediately change the energy of the room…for the worse. It’s important to identify who these people are and prepare yourself for how much energy you invest in your interactions with them. This can look like saying no to clients who make unreasonable demands or adjusting your schedule so there is minimal overlap with a coworker who stresses you out. AVOID ENABLING TRAUMA DUMPING Hair stylists (along with bartenders, nail technicians, and others) are often treated like life coaches or therapists by their clients. Odds are, at some point, someone has crossed the line and unloaded so much emotional baggage that you were exhausted by the time their services were finished. It’s possible to set boundaries and still be supportive. For example, you can validate your clients’ feelings about their situation but choose not to share any of your own experiences that feel similar. Or you can shift the topic of conversation if you don’t have the emotional energy to invest in the direction they are going.   • Bargaining Council: HBSI Pension Fund & Important Reminders on Payments & Documents

    PENSION FUND CONTRIBUTIONS: ARREARS The National Bargaining Council’s Main Collective Agreement provides for the compulsory membership, of employees in the industry, of the HBSI Pension Fund. In the absence of an exemption, it is a legal requirement that employers submit payment of the required contributions to the Council (on behalf of the Employer and of the Employee, as set out in the Main Collective Agreement and Wage schedules) for payment to the Fund and in accordance with the Rules of the Fund. A failure to pay over contributions as required is not only a contravention of the Pension Fund Act, and a criminal offence, but also potentially leaves employers exposed to legal challenges concerning the impact on other benefits such as risk benefits (e.g. death and serious illness) payable to the members. The FSCA (Financial Services Conduct Authority) issued warnings and alerts in June 2022 that they would continue with their enforcement efforts in this regard and have done so and continue to do so. The Council also continues with its enforcement of non-compliance with the Main Collective Agreement Please urgently attend to any Pension Fund arrears. Important Reminders: REFERENCE ON PAYMENTS Please remember to include your SAL Number as a reference when making payments to the Council. We are unable to allocate payments to your accounts unless we know which establishments they are to be applied to. If you forget to do so, please kindly email us the proof of payment and SAL number to accounts@hcsbc.co.za Please ensure you make payment by the date specified on the Returns (i.e. on or before the 7th of the month). Late payments will result in penalties ANNEXURES A AND B AND STAFF AMENDMENT FORMS All employers are obliged to ensure that an establishment is registered with the Council. In terms of the Main Collective Agreement, all employers of an establishment must apply to the Council in the form specified in Annexure “A” for registration of the establishment and shall, as part of the registration process, also submit a duly completed Annexure “B” in respect of all Employees employed at the establishment. (Annexures A and B may be downloaded from the Council’s website www.hcsbc.co.za. The employer must notify the Council of the appointment of an employee (including a learner) by submitting a completed Annexure “B” before the 7th of the month following the appointment. These documents can be submitted to: accounts@hcsbc.co.za. In the event of an employee (including a learner) leaving the services of the employer for whatsoever reason, the employer must notify the Council of such termination in writing. The notice must include the employee’s full name, surname, identity number, position held and last working day and be submitted to amend@hcsbc.co.za before the 7th of the month following the termination of employment. The Staff Amendment Form (Staff Amendment Form) may be used to notify the Council of changes. Please contact your agent or the Council offices should you need assistance. Membership: Any worker can join a trade union voluntarily, and unions often operate at the industry or sector level. Activities: Trade unions engage in collective bargaining, industrial action (such as strikes), and provide support and representation for workers in disciplinary hearings and disputes. Legislative Compliance: Employers: Legally obliged to recognize and engage in collective bargaining with registered trade unions representing their employees. Employees: Have the right to join or form trade unions and participate in collective bargaining activities. They must also adhere to lawful directives issued by their trade unions regarding industrial action or dispute resolution processes. Employers’ Organisations: Definition: Employers Organisations are groups formed by employers to represent their interests in employment-related matters. Purpose: They advocate for the interests of employers in negotiations with employees and trade unions, and also provide support and guidance to their members. Membership: Employers, including businesses, associations, and professional bodies, can join employers' organisations to benefit from collective bargaining, representation, and support. Functions: They engage in collective bargaining, provide guidance on labour laws and regulations, and represent employers in disputes and negotiations with employees and trade unions. Legislative Compliance: Employers: Encouraged to join and participate in Employers’ Organisations to ensure their interests are effectively represented in Bargaining Council negotiations. Employees: No direct legislative compliance obligations regarding Employers’ Organisations, but they may benefit indirectly from their employer's membership through improved labour relations and workplace conditions.
